Further to our recent blog post regarding the grant of a Confiscation Order for £81,744.68 against a convicted Scottish criminal, the High Court in Edinburgh has granted further Confiscation Orders against two convicted drug dealers from Glasgow and Dunfermline.
Confiscation Orders were made for £55,000 and £29,707.00 against James White and Joseph Crichton respectively. The relevant legislation is contained in the Misuse of Drugs Act 1971, Proceeds of Crime Act 2002 and, specific to Scotland, the Proceeds of Crime (Scotland) Act 1995.
Crichton, from Bishopbriggs in Glasgow, was sentenced on 14 July 2010 to six years imprisonment for supplying cocaine. On 5 November 2010, White, from Dunfermline, was sentenced to three years and four months imprisonment after pleading guilty for supplying cannabis resin.
Crown Office and Procurator Fiscal Service (COPFS) Proceeds of Crime Act Champion and Area Procurator Fiscal for Glasgow, Lesley Thomson, said:
"It is our duty to ensure that no one trying to profit from crime should succeed. We are determined to pursue any financial benefits gained from illegal activity.
"By using the Proceeds of Crime legislation we will not only seek to recover assets but we will disrupt activity, prevent the reinvesting of profits, and wherever possible make it very difficult for criminal enterprises to be pursued.
