Sleeping driver avoids driving ban

A father from Argyll has managed to avoid a driving ban, despite admitting drink driving and crashing his car in to a cemetery, reports the Scottish Sun.

The 74-year-old explained to Oban Sheriff Court that he had been asleep throughout the whole incident. The first he became aware of what had happened was when he woke up in his car in the cemetery, wearing pants and a pyjama top and no shoes.

His story was supported by his wife, who confirmed that the couple had gone to bed around 11pm after having a few drinks, and that she woke up around 3am to find her husband missing and the car driving off, crashing through their fence.

The Sheriff accepted the man's special defence of sleepwalking and spared him an automatic one year driving ban. He was given a £500 fine and nine penalty points on his licence.
